1. Acceptance of Terms

Sugr is a product of NextStep Care Systems, Inc. ("NextStep"). By accessing or using the Sugr mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use the App.

2. Overview of the Service

Sugr is a peer-to-peer platform that allows users to create and manage interest-free repayment agreements with people they know and trust. Sugr facilitates the coordination of repayment schedules and payment processing between users.

3. Platform Role and Limitations

Sugr is a technology platform that facilitates private, interest-free agreements between individuals.

Specifically:

  • Sugr does not lend money
  • Sugr does not set loan terms
  • Sugr does not charge interest
  • Sugr does not underwrite or guarantee repayment
  • Sugr does not take custody of user funds

All loan agreements are created voluntarily between users. Sugr is not a party to any loan agreement and does not provide credit, financial advice, or repayment enforcement.

4. Eligibility

To use Sugr, you must:

  • Be at least 18 years of age
  • Have a valid U.S. phone number
  • Have the legal capacity to enter into binding agreements
  • Reside in a state where Sugr is available

5. User Accounts

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

If you believe your account has been compromised, contact us immediately at support@sugr.loans.

6. Repayment Agreements

All repayment agreements facilitated through Sugr are voluntary, interest-free agreements between users. You acknowledge and agree that:

  • Loan terms (including amount, repayment schedule, and duration) are set solely by the users involved
  • Sugr is not a party to any loan agreement
  • Sugr does not mediate disputes or enforce repayment
  • You enter into loan agreements at your own risk

7. Payments and Third-Party Services

Sugr uses third-party service providers to facilitate bank account linking, ACH transfers, and phone verification. These providers may include Plaid, Dwolla, Twilio, and others.

Sugr does not store your bank account credentials. By using the App, you authorize Sugr and its service providers to initiate payments and transfers on your behalf as specified in your loan agreements.

8. Fees

Sugr does not charge interest. Sugr may charge a one-time platform facilitation fee for processed transactions. Any applicable fees will be clearly disclosed before you confirm a transaction.

Sugr may introduce optional paid features in the future. You will be notified of any changes to our fee structure.

9. Prohibited Use

You agree not to use Sugr to:

  • Engage in fraud, deception, or misrepresentation
  • Impersonate another person or entity
  • Conduct illegal activity or violate any applicable laws
  • Use the platform for commercial debt collection
  • Harass, abuse, or harm other users
  • Attempt to circumvent security measures or access unauthorized systems
  • Interfere with the proper functioning of the App

10. No Financial Advice

Sugr does not provide financial, legal, tax, or credit advice. The App is a tool for coordinating peer-to-peer agreements. You should consult qualified professionals for advice regarding your specific financial situation.

11. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. Sugr does not warrant that the App will be uninterrupted, error-free, or secure, or that any particular outcome will result from your use of the App.

12. Limitation of Liability

To the maximum extent permitted by law, Sugr and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the App, including but not limited to loss of funds, failed transactions, or disputes between users.

13. Indemnification

You agree to indemnify, defend, and hold harmless Sugr and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the App, your violation of these Terms, or any loan agreement you enter into through the platform.

14. Termination

You may stop using Sugr at any time. Sugr may suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms. Upon termination, your right to use the App will cease immediately.

15. Changes to Terms

Sugr may update these Terms from time to time. Changes will be reflected by the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes acceptance of the updated Terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
